About Us
James Higgins & Co has established itself as a trusted legal advisor, serving individuals and families for over 28 years. As a third-generation family law firm, we appreciate the uniqueness of each family, recognising their distinct values and aspirations. Our focus is on listening carefully to your needs and offering tailored advice to protect and transfer assets, aiming to foster prosperity and harmony across generations. The legacy of our firm began with James Higgins, whose distinguished legal career commenced in 1964 with a focus on banking and finance. His path led him to become a partner at Mallesons in 1974 before founding James Higgins & Co in 1998. Although retired from full-time practice in 2018, James continues to offer his expertise as a consultant. Leading the firm today is Sasha Bennetts, James' daughter, whose 20-plus years of experience in succession and property law ensures our clients benefit from deep insight and proficient guidance. Our firm offers a comprehensive range of legal services across several areas. In estate planning, we handle everything from the creation of Wills and Enduring Powers of Attorney for financial and personal matters to Advance Care Directives and Guardianship applications. Our property law services include pre-contractual advice, the purchase and sale of property, and dealing with residential and commercial leases, among others. We have extensive expertise in handling self-managed super funds, from settlement to administration, as well as managing family discretionary trusts. Our guidance extends to advising trustees and beneficiaries about their responsibilities and dealing with trust disputes. In estate administration, our services cover obtaining Grants of Representation and advising executors on their duties. We also provide robust representation in estate litigation, including challenging Wills and managing family provision applications. In the commercial sector, we manage family loan agreements and the purchase and sale of family businesses, ensuring that each transaction aligns with our clients' objectives and legal requirements. At James Higgins & Co, we are dedicated to offering legal solutions that are both insightful and practical, tailored to each client's unique circumstances.
