Tom Darbyshire

Tom Darbyshire is a partner in the Litigation & Insolvency team with nearly 30 years of experience in commercial litigation across Western Australia. He has appeared as counsel in almost all State and Federal Courts, bringing comprehensive courtroom expertise to his practice. Tom’s work spans a diverse range of legal matters, with particular focus on bankruptcy, corporate turnaround and insolvency, trust and property disputes, and consumer protection. In addition to dispute resolution, Tom provides guidance on governance and compliance, advising clients on issues such as the Privacy Act, data protection, whistleblower protections for both public and private sectors, and directors’ duties. His broad knowledge in these areas supports clients in managing risk and regulatory obligations effectively. Tom has also contributed significantly to legal practice management, serving as head of the Commercial Dispute Resolution team at Kott Gunning for 15 years and undertaking two terms as managing partner. He is a Fellow of the Governance Institute of Australia and an active member of the Australian Reconstruction Insolvency and Turnaround Association (ARITA).
