Neill McCarthy

Neill McCarthy has been a partner at Creswick McCarthy since 1999. Admitted to practice in 1992, Neill brings extensive experience as a legal advocate. He began his career as a prosecutor with the Director of Public Prosecutions before transitioning to private practice in 1994. Over the years, Neill has developed a broad legal practice, serving a diverse range of private, commercial, and corporate clients. Neill’s practice focuses on court advocacy, appearing regularly in Courts and Tribunals. His areas of work include criminal law, Apprehended Violence Orders (AVOs), contested wills, pre-nuptial and binding financial agreements, civil claims, bankruptcy, traffic law, and human rights law. In criminal law, Neill frequently represents clients in the Local and District Courts, handling serious criminal allegations. His role often involves cross-examining prosecution witnesses such as police officers and expert witnesses. In the area of contested wills, Neill represents both estates and claimants in Supreme Court proceedings. These matters typically concern whether eligible persons have been adequately provided for under a will, balancing the testator’s intentions with the rights of claimants. Neill also advises and acts for clients involved in civil disputes, representing plaintiffs and defendants in various matters. He has experience negotiating contractual disputes, conducting settlements, and participating in formal mediations. His dispute resolution expertise supports clients from initial instructions through to the conclusion of court proceedings if necessary. Beyond his practice, Neill has contributed to legal education by teaching law courses and serving as a Local Court arbitrator since 2012. He is also an academic marker for the NSW Police Academy at Charles Sturt University. Neill holds a Bachelor of Science with Honours in Psychology from University College London (1982) and a Bachelor of Laws from the University of New South Wales (1992). In his personal time, he enjoys beekeeping, brewing beer, and motorcycling.
