You are not able to market your property before the contract is drafted. The contract MUST contain certain documents including searches, documents from your local council and certain disclosures and warranties. If these documents are not correct, the purchaser of your property may be able to get out of the contract, leaving you stranded. Probate

An executor may need to apply for Probate in the Supreme Court before administering an estate. The granting of Probate ‘proves’ the Will of the deceased and authorises the executor to deal with the estate. The requirement to obtain probate depends on the size of the estate, the type of assets and how they are held. Most financial institutions require a grant of probate to release funds over a specified amount. Probate is also required to transfer real estate that is not jointly held. It is the executors role to ensure that the will is administered in accordance with the Testators wishes. If you don’t have a Will your assets will be divided according to how the law dictates in the rules of intestacy, that is, when you have not made a Will. If you die intestate it is very likely that your estate will not be distributed as you would have desired. A Will is also the place where you can indicate to your family and friends your wishes on other important matters, such as who you want to be the guardians of your children. Making a Will shows a level of care in not wanting to give loved ones any more stress to deal with than they will already face when you pass away. In many ways it is one of the most selfless things you can do.
